Terms of Service / User Regulations

These Terms of Service / User Regulations (the Terms) govern use of Art Argentum public pages, user accounts, workspaces, APIs, paid features, analytical outputs, AI and LLM functionality, strategy tools, backtests, agents and other electronically supplied services made available through the platform.

Where Polish law applies, these Terms are intended to constitute the regulations for the provision of services by electronic means within the meaning of the Polish Act on Providing Services by Electronic Means.

The current Terms are made available free of charge before a user enters into an agreement for an electronic service and should be accessible in a form that allows the user to retrieve, reproduce and store them. A user is not bound by terms that were not made available in the legally required manner.

By creating an account, expressly accepting these Terms where acceptance is requested, ordering a paid service or otherwise entering into an agreement for a service, the user agrees to the version of these Terms applicable to that agreement.

The placeholders in this section must be replaced with the operator's actual statutory details before commercial launch. The service must not rely only on checkout screens for information that applicable law requires to be directly and permanently accessible.

• Art Argentum / Platform — the website, account workspace, APIs and related electronic services offered under the Art Argentum brand.
• User — a natural person, legal person or organizational unit using the Platform; Consumer — a natural person acting for purposes outside their trade, business or profession, and where mandatory Polish law so provides, a natural person conducting business who is granted consumer-like protection for a non-professional contract.
• Account — an authenticated user profile providing access to private Platform functionality.
• AI / LLM Service — functionality that uses artificial intelligence or large language models to generate, transform, classify, analyze or act on information.
• Digital Service — a service allowing the User to create, process, store, access or interact with data in digital form, including eligible Platform, agent and workspace functionality.
• Digital Content — data produced and supplied in digital form, which may include eligible files, exports or other downloadable digital outputs.
• Wallet / Credits — a contractual service balance that may be used to pay for eligible Art Argentum usage; it is not a bank account, deposit, security or investment product.

• Account registration, authentication and private workspace functionality.
• Market-data, chart, macroeconomic and public-source intelligence tools.
• Source monitoring, structured research, libraries and user-configured monitoring workflows.
• AI/LLM research, strategy development and trading-agent functionality.
• Deterministic algorithmic strategy building, backtesting, simulation and benchmarking functionality.
• Programmatic access through APIs and eligible data downloads or exports.
• Usage-based paid functionality, Wallet/Credits, enterprise services and other features described in the applicable Offer, Pricing, Billing or checkout interface.

Basic use requires an internet-connected device, a current web browser capable of secure HTTPS communication, and the ability to display standard HTML/CSS content. Interactive workspace functions may require JavaScript, cookies or local storage to be enabled. Account functions may require a valid supported authentication method and email address. API access requires compatible HTTPS client software and valid credentials or API keys.

The exact requirements of a feature may depend on the browser, operating system, authentication provider, data source, API version, model provider or third-party integration used by that feature.

Risks associated with electronic services include network interruption, unauthorized account access, credential theft or phishing, malware or malicious links from external sources, software incompatibility, data loss, third-party outages, incorrect or delayed data and errors in automated or AI-generated output. Users should maintain suitable device security, protect credentials and independently verify consequential information.

Art Argentum uses reasonable technical and organizational safeguards, but no internet service can guarantee uninterrupted availability or complete security.

Account, paid, API, trading-agent and execution-related features are intended for users who have the legal capacity required to enter into the relevant agreement. Public informational pages may be browsed subject to applicable law.

If you use Art Argentum on behalf of an organization, you represent that you are authorized to bind that organization to the applicable agreement.

Users are responsible for complying with laws, broker or exchange rules, sanctions, professional obligations and internal policies applicable to their use of the Platform.

A free account agreement is concluded when the User successfully completes the account creation or authentication flow, is given access to the Account and, where the interface requires it, accepts these Terms.

A contract for a paid service, Wallet/Credit purchase, paid data access, model usage, agent usage, API entitlement, subscription or other commercial feature is concluded when the User completes the relevant order flow and Art Argentum confirms the order or makes the purchased entitlement available, unless the checkout states a different legally effective moment.

Before an online order that creates a payment obligation, the checkout must clearly display the legally required pre-contract information, including the principal characteristics, total price or pricing method, duration/minimum commitment where applicable and the fact that the order creates an obligation to pay.

Any button or equivalent function used to place a consumer order with a payment obligation must use clear wording equivalent to 'order with obligation to pay' or another formulation that unambiguously communicates the payment obligation.

Prices, usage units, applicable taxes, billing logic, minimum charges, limits and any recurring payment terms are displayed in the relevant Offer, Pricing, Billing, API documentation or checkout interface before the paid order is placed.

Where charges are usage-based, the interface or applicable documentation describes the unit or event that triggers a charge. Discovery, list or index requests may be priced differently from individual data items or generated outputs where the product description so states.

A Wallet/Credit balance represents prepaid contractual access to eligible Platform services. Any rules concerning expiry, refundability, promotional credits or service-specific restrictions must be disclosed before the relevant purchase or grant and remain subject to mandatory consumer law.

Payment may be processed by third-party payment providers. Art Argentum does not require users to disclose full payment-card credentials directly to AI or LLM interfaces.

A free Account agreement is generally concluded for an indefinite period unless a specific feature states otherwise. A paid service may be one-off, usage-based, time-limited, recurring or continuous as described before purchase.

A User may stop using public or free services at any time. Where Account closure functionality is available, the User may use it; otherwise the User may request Account closure through the official contact channel, subject to identity verification, settlement of pending transactions and mandatory retention obligations.

Where a recurring service is offered, the relevant checkout or billing interface must state its duration, renewal rules and method of cancellation before purchase.

Art Argentum may terminate or suspend an agreement in the circumstances described in these Terms, including material breach, unlawful use, security risk, fraud, payment failure or circumstances making continued provision unlawful or technically impossible, subject to mandatory law.

Complaints concerning the operation of the Platform, Accounts, billing, electronic services, digital content or digital services may be submitted to [email protected]. The User should, where possible, identify the Account, affected service, date/time, transaction or job identifier, relevant URL and a description of the issue. Failure to provide non-essential information does not invalidate a complaint.

Consumer complaints are answered within 14 days of receipt unless a different mandatory period applies. A response to a Consumer complaint is provided on paper or another durable medium as required by applicable law.

For technical incidents, Art Argentum may request reasonable cooperation needed to diagnose whether a problem results from the Platform, third-party dependency or the User's digital environment, while using the least burdensome means reasonably available.

Submitting a complaint does not limit any mandatory statutory remedies available to the User.

Mandatory consumer rights remain unaffected by these Terms. Where the Polish Consumer Rights Act applies to paid Digital Content or a Digital Service, Art Argentum remains responsible for conformity with the contract to the extent required by law.

The relevant Digital Content or Digital Service should correspond to the description and functionality promised for that transaction and, where legally relevant, to the compatibility, interoperability, continuity, updates and other requirements applicable to the contract.

If Digital Content or a Digital Service is not in conformity with the contract, a Consumer may have the right to require that it be brought into conformity and, in circumstances defined by law, may have rights to a proportionate price reduction or withdrawal from the contract.

Where a continuous Digital Service is changed for reasons other than maintaining conformity, such change may be made only on a contractual and legal basis that permits it, without additional cost to the Consumer and with the information and remedies required by mandatory law.

Unless a statutory exception applies, a Consumer who concludes a distance contract may generally withdraw from it within 14 days without giving a reason. For service contracts, the period normally runs from conclusion of the contract.

If a Consumer expressly requests that a paid service begin before the withdrawal period expires, the User may be required to pay an amount proportionate to the service actually supplied before withdrawal, where the statutory conditions for such payment are satisfied.

For Digital Content not supplied on a tangible medium, the statutory right of withdrawal may be lost only where all conditions required by law are satisfied, including the Consumer's prior express consent to begin performance before the withdrawal period expires, acknowledgement of the resulting loss of the withdrawal right and the required confirmation on a durable medium.

Funding a Wallet/Credit balance does not by itself create a blanket waiver of mandatory withdrawal rights. The legal effect depends on the service or Digital Content purchased or consumed and the applicable statutory rules.

To exercise a withdrawal right, the Consumer may send an unambiguous statement to the operator's postal or email address identified in these Terms. A model withdrawal form is provided below for convenience but its use is not mandatory.

Some Art Argentum features use artificial intelligence systems and large language models. Interfaces directly exposing AI or LLM functionality identify the AI/LLM nature of the interaction where it is not otherwise obvious from the context of use.

AI output is probabilistic and may contain factual, calculation or coding errors, omissions, inconsistent reasoning, fabricated details or other model failures. Similar inputs may produce different outputs.

AI systems may summarize, classify, generate research hypotheses, interpret market context, produce code, propose or modify strategy logic, select actions or produce trading-agent decisions depending on the feature.

Users must independently review consequential AI outputs rather than treating them as verified facts solely because they were generated by the Platform.

Art Argentum may use models, APIs, infrastructure and AI services supplied by third parties. Model availability, behaviour, context limits, latency, safety controls, pricing and technical characteristics may change independently of Art Argentum.

A workflow may use different model versions or providers over time. Identical prompts or strategy instructions therefore may not produce identical results across dates or versions.

Where AI is given access to Platform tools, code execution, APIs or other actions, the available tool scope is limited by product settings, permissions and technical safeguards. Users remain responsible for configuring and supervising workflows appropriate to their use case.

A general statement in these Terms does not replace any content-specific disclosure required when a person first interacts with an AI system or is exposed to AI-generated or AI-manipulated content.

Where Art Argentum publishes AI-generated or AI-manipulated text for the purpose of informing the public on matters of public interest and that text has not undergone substantive human review or editorial control with editorial responsibility, the publication may require a clear AI disclosure under applicable law.

Substantive human review concerns the substance of the content and should involve relevant knowledge and judgment. Purely formal, grammatical, formatting or procedural checks are not equivalent to substantive review.

Where Art Argentum is responsible as a provider for a generative AI system whose synthetic outputs fall within applicable machine-readable marking requirements, technical marking or provenance measures are handled at the system or output layer. These Terms do not substitute for those technical measures.

Where supported, Art Argentum may retain or display provenance information such as AI-generation status, model/system identifiers, generation time, source references and human-review status.

Trading and investment activity involves risk of loss, including possible loss of all capital allocated to a strategy. Market conditions can differ materially from historical observations or model assumptions.

Where a workflow is connected to a broker, exchange, execution API or other trading system, orders and positions may be affected by spread, commissions, slippage, latency, liquidity, partial fills, rejections, gaps, halts, broker rules, exchange rules, funding costs, delayed data and outages.

Art Argentum does not guarantee that a model decision, instruction, limit, stop, trailing stop or strategy action will be executed at the expected price or at all.

Users are responsible for their broker/exchange accounts, permissions, credentials, capital allocation, leverage, position sizing, risk limits and decision to enable live or automated execution.

An LLM-driven agent may keep an AI model in the decision loop and may generate or revise decisions as context changes. Such behaviour can be non-deterministic even when surrounding workflow settings are fixed.

A deterministic algorithmic strategy applies coded rules to its inputs. AI may be used during research, design or code generation, but once a deterministic strategy is defined, intended execution follows that code and configured parameters rather than open-ended model reasoning.

Users should understand the operating mode of a particular agent or strategy before enabling automation or comparing performance.

Backtests and simulations are hypothetical and depend on historical data, modelling assumptions, execution assumptions, costs, transformations, parameters and implementation details.

Historical or simulated performance is not live performance and does not predict or guarantee future results. Strategies can overfit historical data and fail when market structure, volatility, liquidity, correlations or execution conditions change.

Paper trading and public benchmarks may differ materially from live execution because simulated environments may not reproduce all spreads, commissions, slippage, queue priority, market impact, outages, rejected orders or liquidity constraints.

Users should examine methodology, trade count, drawdown, assumptions and failure periods rather than relying only on headline profit figures.

Art Argentum may process market data and publicly available third-party materials including media, video, audio, websites, publications, feeds, APIs and other sources.

Third-party data may be delayed, incomplete, inaccurate, unavailable, revised or subject to licensing and access restrictions. Art Argentum does not claim ownership of third-party materials merely because they are referenced or processed.

Users should verify time-sensitive or consequential information against the relevant primary source, market venue, broker, data vendor or other authoritative reference.

• Users are responsible for protecting login credentials, API keys, broker credentials, tokens and other authentication information associated with their Account.
• Do not expose credentials in prompts, public agents, public repositories or other places where unauthorized parties may obtain them.
• Notify Art Argentum promptly if you reasonably suspect unauthorized access.
• Art Argentum may apply authentication, session, anti-abuse, rate-limit or security controls and may temporarily restrict access where reasonably necessary to protect accounts or systems.

API access is subject to authentication, rate limits, usage limits, billing rules, endpoint availability and documentation applicable to the relevant service.

Users must not bypass access controls, billing logic, rate limits or technical restrictions, and must not use automated access to interfere with availability or obtain data beyond the access rights granted to the Account.

Users integrating Art Argentum into external systems are responsible for downstream validation, security, retries, error handling, monitoring and safeguards before acting on API output.

Users may submit prompts, strategy descriptions, code, files, agent instructions, monitored-source selections, API requests, research questions, configuration and other content or data.

Users are responsible for having the rights and legal basis required to submit and process that material and must not unlawfully disclose confidential information, personal data, trade secrets or third-party intellectual property.

By submitting content, the User authorizes Art Argentum to process it to provide, secure and maintain the requested service, subject to the Privacy Policy and any applicable enterprise or data-processing agreement.

Where a feature allows user-supplied information, agent descriptions, prompts, strategy information or other material to be made public, the User remains responsible for the material they request to publish and confirms that publication is lawful and does not infringe third-party rights.

Art Argentum may restrict, demote, disable or remove user-supplied information, or restrict related Account functionality, where reasonably necessary because content is unlawful, infringes rights, creates security or market-abuse risk, contains malicious code, exposes confidential credentials, is materially misleading about trading performance, or violates these Terms.

Moderation may involve automated signals, technical rules and human review. Where applicable law requires reasons, notice, review or redress for a moderation decision, Art Argentum will provide the legally required mechanism. A User may challenge a moderation decision through [email protected] unless a dedicated interface is provided.

If Art Argentum enables broader public hosting or dissemination of user content, the Platform's obligations under the EU Digital Services Act and other intermediary-service rules must be assessed for that functionality and may require additional notice-and-action or complaint procedures.

AI-generated output may not be unique. Similar or identical output may be produced for other users, and Art Argentum does not guarantee that generated text, code, logic, names or ideas are novel, copyrightable, patentable or free of third-party rights.

Subject to applicable law, third-party rights, model-provider conditions and specific commercial terms, Users may use outputs made available through their Account for lawful purposes.

Art Argentum retains rights in the Platform itself, including software, interfaces, infrastructure, schemas, proprietary workflows, original datasets and brand elements. Third-party source materials remain subject to their respective rights.

• Do not use Art Argentum for unlawful, fraudulent, abusive or intentionally harmful activity.
• Do not provide or transmit content of an unlawful nature, including content that infringes intellectual property, privacy, data-protection or other rights.
• Do not attempt to bypass authentication, billing, access controls, technical safeguards or rate limits.
• Do not introduce malware, exploit vulnerabilities, interfere with availability or attempt unauthorized access to another user's data or workspace.
• Do not submit content or data that you do not have the right to use or process.
• Do not misrepresent AI-generated, simulated or backtested outputs as verified live performance where that representation would be misleading.
• Do not use the service in violation of applicable market-abuse, sanctions, financial-market or anti-fraud rules.
• Do not remove, falsify or deliberately conceal AI-generation labels, review-status disclosures or provenance markers supplied by Art Argentum where doing so would make redistributed content misleading.

The Platform may depend on hosting providers, authentication providers, model providers, market-data vendors, public platforms, payment processors, email providers, brokers, exchanges or other third parties.

Third-party services are governed by their own terms and may change or become unavailable. Art Argentum is responsible for its own contractual and statutory obligations but does not control third-party systems.

Art Argentum may maintain, update, replace, limit, suspend or discontinue features, models, data feeds, sources, agents or endpoints where reasonably necessary for security, legal compliance, technical maintenance, provider changes, product development or other legitimate operational reasons.

For Consumers receiving a continuous paid Digital Service, changes that are not required to maintain contractual conformity are subject to the contractual basis, justification, notice and remedies required by mandatory consumer law.

Unless a separate service-level agreement expressly provides otherwise, the Platform does not guarantee uninterrupted availability or a specific response time, model version, data source or execution path.

Art Argentum may send communications necessary to operate an Account, confirm transactions, notify security events, provide legally required information or respond to user requests.

Electronic marketing communications are sent only where Art Argentum has a lawful basis or consent required by applicable law. Marketing consent, where required, is separate from acceptance of these Terms and may be withdrawn in the manner provided with the communication or privacy settings.

Use of Art Argentum is also governed by the Privacy Policy, which describes processing connected with accounts, analytics, billing, workspaces, AI features, prompts, model providers, public-source processing, APIs, security and applicable data-protection rights.

The Privacy Policy is available at /privacy-policy/.

To the maximum extent permitted by applicable law, Art Argentum is not liable for indirect, incidental, consequential or special losses arising from use of the service, reliance on model or analytical output, market activity, third-party services, service interruption or loss of data.

Trading losses, lost profits, missed opportunities, market losses, strategy failure and losses caused by external brokers, exchanges, data providers or model providers remain subject to the legal allocation of responsibility applicable to the circumstances.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer rights.

Art Argentum may suspend or restrict access where reasonably necessary to address security threats, fraud, abuse, payment failure, unlawful activity, material breach of these Terms or serious operational risk.

Where required by applicable law, the User will receive notice, reasons or an opportunity for review. Immediate restriction may be used where delay would create a material security, legal or third-party risk.

Provisions that by their nature should survive termination may continue to apply, including payment, intellectual-property, disclaimer, liability and dispute provisions.

These Terms are intended to be governed by Polish law, without depriving Consumers of mandatory protections available under the law that applies to them.

Consumers may use courts and public consumer-protection mechanisms available under mandatory law. Information about available Polish consumer assistance and out-of-court dispute resolution may be obtained from competent consumer authorities and authorized ADR entities.

Before formal proceedings, Users and Art Argentum are encouraged to attempt good-faith resolution through the complaint/contact channel, but this does not limit statutory rights or limitation periods.

Art Argentum may update these Terms to reflect changes in services, AI functionality, billing, APIs, security, law or business operations.

Material changes will be published with an updated revision date. Where an ongoing agreement or mandatory law requires advance notice, consent or a right to terminate because of a change, the required mechanism will be provided.

Continued use after an updated version becomes effective constitutes acceptance only to the extent permitted by applicable law and the contractual relationship with the User.
